The president of the EU commission, Ursula von der Leyen, said on Friday that the EC will do everything in its power to ensure European law primacy.
This comes after the ruling of the highest court in Poland, which she said is deeply concerning.
The Polish Constitutional Tribunal ruled on Thursday that some parts of EU law are conflicting with Poland’s constitution.
Consequently, this move escalated the row between Brussels and Warsaw as it challenges an essential EU pillar.
“EU law has primacy over national law, including constitutional provisions,” von der Leyen stated.
“This is what all EU member states have signed up to as members of the European Union,” she continued.
Additionally, “We will use all the powers that we have under the treaties to ensure this.”
The EU executive’s chief ordered a detailed and quick analysis of the ruling to plan for the Commission’s next steps.
Additionally, Von der Leyen said the EU was a community of rules and values on which 450 million Europeans, including Polish citizens, relied.
“Our utmost priority is to ensure that the rights of Polish citizens are protected,” she added.
Moreover, she concluded that citizens of Poland must enjoy the benefits the European Union’s membership grants them.
Besides, citizens and businesses needed legal certainty that Poland still applies the EU and the European Court of Justice rules.
“Our treaties are very clear. All rulings by the European Court of Justice are binding on all member states’ authorities, including national courts,” she stated.
